Representing yourself, is it a good idea?
There is nothing worse than being prevented from seeing your children. Before you separated you probably saw them everyday and took it for granted. After separation, when your time is unreasonably limited, or non existant, you cannot just sit back and hope for the best. You need to take steps to recover your relationship with the children. When talking, Mediation and involving family or friends does not work, Court is your last option, and it should be your last option. Going to court can be frustrating, unfair, illogical and they can make mistakes. You do not know what your ex will throw at you, but when it is your only option, then you need to approach it with a plan, with an understanding if what is involved, and do everything that you can to increase your chances of success.

Part One 

Children cases Part One will cover everything from contemplating making an application through to the end of the First Hearing, the FHDRA. When you separate there are often disagreements about who sees the children for what time. It doesn’t help that this has a direct link to Child Maintenance and money. You may have reached an agreement, but is that a good agreement or a bad one? Being supervised in your exes house is a bad agreement. Sometimes you have little choice but to accept what you can, but the bottom line, last resort would (should) be a Court Application. So if you know what the court will order, you know where you stand. The court may take several months to get to a conclusion, but you can at least weight up the pro’s and con’s and know where you stand.
Leading you through mediation to the type of application to make and completing the forms correctly, the Safeguarding Interview which will set the scene for the first hearing, preparing for the hearing and then attending court and understanding what is involved, what the court will do and how it will look at your case. All of this is included in Part One. It also includes sample documents and templates where necessary.

Part Two

Children Cases Part Two will take you from your first hearing through to and including a Final Hearing. It will cover the Section 7 Report which is common in most applications that don’t settle at the FHDRA, and the interview that you have with CAFCASS. The report will contain a recommendation for time with the children. Depending on that recommendation you will either accept it or challenge it at the next hearing. You may then need to go to a Final Hearing where you make that challenge in open court. Cross examination, Closing Submissions and the conduct and process of a Final Hearing are all covered. The course also includes sample documents and templates where necessary.
