<h2 id="1eabcef3-b6d7-4161-82bd-6cae961a4139" data-toc-id="1eabcef3-b6d7-4161-82bd-6cae961a4139" style="font-size: 24px; font-weight: 600; line-height: 1.2;">From Application through to the end of the FDA Hearing</h2><h5 id="35119e3c-0639-449f-80c8-52f3788beaa9" data-toc-id="35119e3c-0639-449f-80c8-52f3788beaa9" style="font-size: 16px; font-weight: 600; line-height: 1.2;"></h5>This course covers everything that you need to know to work through from considering making an application to the end of the FDA hearing.At the FDA Hearing the Judge is only concerned in assessing the ‘value’ of the marriage. The Assets and the Liabilities and also looking at anything that came before, or after, the marriage.&nbsp; It is the first step towards being able to assist the parties to reach a compromise.&nbsp; The court is not particularly interested in behaviour unless it is extreme.&nbsp; And that it affects the financial position.&nbsp; Most people want to use it as a way to batter the other party and make them look bad, but it is not the place for that and it wont have any effect either unless it fits the courts threshold which is ‘extreme’The FDA Hearing is usually online as the court can get through more cases and use a Judge that is anywhere in the country to conduct the hearing.The Judge will generally look at the ES1 and ES2 to see what each side is asking to happen, and then check whether the value of the property is agreed, or can be agreed, and then go through the Questionnaires, removing questions which are not appropriate.Sometimes the other side will not have prepared the appropriate paperwork for this hearing and the Judge will simply give them another 14 days to comply with the order.Following the hearing you will have an Order to take you to the FDA Hearing which is likely to be about 2-3 months away and which will be a face to face hearing.It is possible to make offers to settle at anytime in this process and they should be considered to avoid going to Court if possible.<hr>Preparing for the FDA HearingThere are several documents required for this Hearing, the main one being the Form E.&nbsp; These are exchanged two weeks before the hearing and then you are able to raise a Questionnaire to uncover anything that the other side is hiding.&nbsp; You will need to provide Bank Statements, Mortgage Balance, House values, alternative properties you can both live it, and a raft of other paperwork.&nbsp; Each and every document is explained with samples in this course.&nbsp;The Form E in particular is a very important document, as if your case goes to a Final Hearing you will be cross examined on its contents.At all times it is a good idea to look at how to settle the case.&nbsp; The Court Hearings are just a process, which is in place when people cannot agree.&nbsp; It doesn’t stop you from reaching an agreement.&nbsp;
