Dealing with the outcome of the final Hearing

<h1 id="1eabcef3-b6d7-4161-82bd-6cae961a4139" data-toc-id="1eabcef3-b6d7-4161-82bd-6cae961a4139" style="font-size: 32px; font-weight: 600; line-height: 1.2;">From the FDR Hearing to the Final Hearing. (England &amp; Wales)</h1>Following the Financial Dispute Resolution Hearing (FDR), it is not too late to still reach an agreement.&nbsp; There is also a very important step to take before you go any further.At the FDR Hearing the Judge would have been doing all they could to try to get you to reach an agreement.&nbsp; The only reason they may not have suggested a settlement would be when it is clear that no agreement is possible and so a Final Hearing is inevitable.&nbsp; Usually when one party has withdrawn from the process, or the disclosure is so bad that it cannot be relied upon.Usually however, a settlement was suggested and no agreement was made.&nbsp; So the Court will make an order to progress to a Final Hearing.At this point you need to think carefully about your Offer at the FDR and the Judges advice.&nbsp; The Judge made an estimate based on what he feels all judges will make.&nbsp; You need to make a written offer to your Ex at the level suggested to draw a line in the sand.&nbsp; It will protect you from the issue of paying their costs if they have been unreasonable.<hr>Preparing for the Final HearingYou will need to write a Section 25 Statement.&nbsp; This needs to explain your position related to your offer made at the FDR and what you want the outcome to be at the Final Hearing.&nbsp; This document is very important and will be the basis for your cross examination at the hearing.&nbsp; Similarly., you will be questioned about the contents of your Statement.After the S25 Statement is exchanged, you will need to prepare:<ul style="margin-top: 0cm;"><li>Closing Statement</li><li>Cross Examination</li><li>Potentially a Note for the Hearing</li><li>An Open Offer</li></ul>Having the benefit of the FDR Hearing, you need to present a realistic and credible settlement proposal. It will also allow you to determine the lowest position you are willing to accept before going into Court for the Final Hearing.&nbsp; You can reach a settlement at anytime up to walking in to Court.
