This stage needs to be managed properly to prevent repeated and excessive requests for further information, which can often lead to significant frustration and delay.You may feel that some of the questions raised are unnecessary or inappropriate. This course explains how to deal with such questions correctly, including when and how to challenge them, and provides sample documents to guide you through the process.<hr><h3 id="e4631829-6132-4887-99be-c8ec7242a83f" data-toc-id="e4631829-6132-4887-99be-c8ec7242a83f" style="font-size: 20px; font-weight: 600; line-height: 1.2;">Preparing for the FDR Hearing</h3>You will also need to give serious consideration to the offer you intend to make at the Financial Dispute Resolution (FDR) Hearing, as this hearing is specifically focused on achieving a settlement.Unlike the FDA, the FDR hearing is always conducted in person and is a key opportunity to resolve the financial aspects of your case, often with strong encouragement from the court.Proper preparation of your documentation is critical to the outcome. Understanding how the court will assess:<ul><li>Assets and liabilities</li><li>Pre-marital property</li><li>Inherited assets</li><li>Post-marital financial arrangements</li></ul>will help you to present a realistic and credible settlement proposal. It will also allow you to determine the lowest position you are willing to accept before deciding whether a Final Hearing is necessary.<hr><h3 id="a36ba543-17a8-42c5-a749-39af626c76b3" data-toc-id="a36ba543-17a8-42c5-a749-39af626c76b3" style="font-size: 20px; font-weight: 600; line-height: 1.2;">Why the FDR Hearing Matters</h3>The court will actively encourage agreement at the FDR stage. If a settlement cannot be reached — often due to the unreasonableness of one party or unresolved issues such as alleged hidden assets — the case will usually proceed to a Final Hearing.Final Hearings are extremely expensive, particularly where one party is legally represented, and there is always a risk that the court may order one party to contribute to the other’s legal costs.For these reasons, the FDR Hearing is a pivotal stage in the proceedings, with a great deal riding on proper preparation and strategy.
